An extra 90 days of foreclosure breathing room…maybe…

governor-arnold-schwarzeneggerStarting on the 15th of June 2009 California has a new 90 day foreclosure moratorium law take effect.  Similiar to the bill, “Making Home Affordable”,  Obama passed back in March.

This bill was passed to make lenders try harder to keep boorrowers (you) in their homes.  The lenders must prove that they tried to modify any delinquent loans before starting the foreclosure process.

What this law does, in practical purposes, is add 90 days from the time that the Notice of Default (NOD) is sent to when they are allowed to file a Notice of Trustee Sale (NTS).  In the past lenders are allowed to file the NTS 90 days after the NOD was filed, and now with the new bill there is an extra 90 days tacked on giving the homeowners 180 days after NOD before the NTS.  There are a couple of provisions to qualify for this extra 90 days:

  • the loan was recorded from Jan 1 2003 to Jan 1 2008
  • this was the original loan used to purchase the property (not a refinance)
  • the home is your primary residence (or was if you receive the NOD while you lived there)

The news is not all roses and cream however, some may even say that this bill is a joke.  The lenders can petition for exemption from the bill, from what I can tell all they have to  prove that they have a loan modification program in place.

Quicker access to that $8000 tax credit

Economic StimulusWhen the economic stimulus plan was introduced in February it included the $8000 tax credit for first time home buyers.  Originally home buyers would only receive this credit from the IRS after tax season or filing an amended return.  In an effort to boost home sales even more the Department of Housing and Urban Development has unveiled a a policy change that will allow borrowers who are using a FHA approved lender to get an advance of the tax credit up front in order to be able to afford the costs associated with the home purchase.

There is a restriction however, this advance cannot be used as part of the 3.5% down payment that you need to have as part of using a FHA loan.   A typical loan has $3000 to $4000 in closing costs, title insurance and other fees, this advance can be used by the borrower to meet all of these costs.  According to Shaun Donovan, Secretary of Housing and Urban Development, “What we’re doing today will not only help these families to purchase their first home but will present an enormous benefit for communities struggling to deal with an oversupply of housing.”

It might not be a huge carrot, but at least it’s not a stick

carrot-and-stickLast month, the Obama administration passsed the Making Home Affordable program which offered lenders and loan providers an incentive of up to $1,000 for each completed short sale, and up to $1,000 more to share the cost of paying any second-mortgage lenders to release their claim on the property.  Homeowners were’nt left out in the cold, they were offered up to $1,500 for relocation expenses.  In this market any extra incentive the lender gets can be nothing but a good thing when it comes to helping the homeowner out of a bad situation.  Now, also, the homeowner has one less objection, can’t afford the move, to just face reality and make the leap into a Short Sale.  Analysts believe short sales are often the best option, even for homeowners thinking about a new loan to save the home. “It’s gotten to the point where people understand that sometimes you have to start over,” says Andre L Mitchell of VP of Lynx Mortgage Bank.  ”A loan modification might help you in the short term, but sometimes what people need to do is get out completely.”

Life’s Better in North Carolina

I just found out the good news.  Sounds the Movie, in which I played the part of Agent Miller, is being released in North Carolina sometime next year.  As one of the original 13 colonies, back then it was just Carolina, we know they have history.  Now with the release of Sounds the Movie we know also that they have good taste.

Lambs, Cows and Horses, Oh My!

For a great outing, in Spring or any time of the year, come visit the
Raphael Garden in Fair Oaks.  Conveniently located on Fair Oaks Blvd between
San Juan and Sunrise, a short walk from the Rudolf Steiner College parking
lot takes you into a wonderful world that seems surprisingly far away from
the whizzing cars and bustle you just left behind.  Six young lambs enjoy
the lush grass with their mothers, a friendly white horse loves the handfuls
of grass or rose hips you offer, and Mona the calf loves to rub her head
(and horns, parental discretion advised) on your leg. Mona’s mother Bella
usually just likes to be petted. Chickens, bees, ducks and the incredible
garden all await you.  Come by any Thursday around lunch time and you’ll
probably see me and my granddaughter Maya – she’ll be eager to welcome you
too!

First Time Home Buyers in Sacramento Rejoice!

Free Money for your new homeFirst things first, despite the title, you do not need to be a first time home buyer to qualify for this program.  You also qualify if you have not owned and occupied a home as a principal residence within the preceding three years and the home you are buying is within a federally designated target area, more info below.

If you live in the Greater Sacramento Area (Sacramento, Elk Grove, Folsom, Isleton, Galt, Citrus Heights, Rancho Cordova and the unincorporated areas of the County of Sacramento) and are looking to buy your first home (or if you qualify, read below) then you are in luck.  Here is a program to help you realize this dream.  The Sacramento Mortgage Credit Certificate (MCC) Program is designed to help you get into your new home.  The MCC reduces the income tax you would have to pay, which in turn allows you more available income to qualify for a mortgage and to help you make your monthly mortgage payments.

To be eligible for this program you must meet the following criteria:

  • You are first-time homebuyers (have not owned and occupied a home as a principal residence within the preceding three years) (in federally designated target areas, you do not have to be a first-time homebuyer)
  • You are able to qualify for a loan to purchase the home
  • You will live in the home being purchased
  • do not exceed the following income limitation:

1 or 2 person households:  $87,360

3 or more person household:  $101,920

Eligible properties must be  Single Fmaily homes and must cost less than $554,025.

homeowners avoid foreclosure.  His plan will help up to 9 million homeowners trying to avoid foreclosure on their primary residence.

Since Loan Modifications are evaluated on a case by case basis it is always good to be prepared before calling your lender.  Here is a list of the important documents and information that you should have ready:

  • Loan number
  • Income information and documentation
  • Most recent mortgage statement
  • Bank statements
  • Letter demonstrating financial hardship
